III. The details of data processing


  1. Automated decision in individual cases including profiling 

We do not carry out decision-making based exclusively on automated processing - including profiling.

Our processor Shopify uses limited automated decision making to prevent fraud that does not have a legal or otherwise significant impact on you.

Services that include elements of automated decision making include:

Temporary blacklist of IP addresses associated with repeatedly failed transactions. This blacklist remains in place for a small number of hours.

Temporary blacklist of credit cards associated with blacklisted IP addresses. This blacklist remains in place for a small number of days.

  1. Server log files

If you use this website without otherwise transmitting data to us (e.g. by registering or using the contact form), we collect technically necessary data via server log files that are automatically transmitted to our server, including: IP address; Date and time of the request; Name and URL of the accessed file; Website from which the access is made (referrer URL); Access status/HTTP status code; Browser type; Language and version of the browser software; Operating system.

This processing is technically necessary in order to display our website to you. We also use the data to ensure the security and stability of our website. The legal basis for this processing is Art. 6 (1) f) GDPR. The processing of the aforementioned data is necessary for the provision of a website and thus serves to protect a legitimate interest of our company.

  1. Measures and for contract performance

In the pre-contractual area and when concluding the contract, we collect personal data about you. This concerns, for example, your first and last name, address, e-mail address, telephone number or bank details.

We collect and process this data exclusively for the purpose of executing the contract or fulfilling pre-contractual obligations. The legal basis for this is Art. 6 (1) b) GDPR. 

  1. Order

There is an order form on our website which can be used for electronic pre-orders.

Our data collection is limited to the following data: Salutation; First name and surname; Company name; Address and address; Telephone number; E-mail address; Account data; Name and characteristics of the product.

The purpose of the data processing is to be able to process your order properly. The
legal basis for this is Art. 6 (1) b) GDPR. The processing of the data serves the fulfilment of a contract or is necessary for the implementation of a pre-contractual measure, which has taken place at the request of the data subject.

Registration

You can register on our website. When you register, we collect and store the data you enter in the input mask (e.g. last name, first name, email address). This data will not be passed on to third parties.

Your registration is necessary for the use of certain content and services on our website or for the performance of a contract or for the implementation of pre-contractual measures. After registration, you are free to change the personal data provided during registration at any time or to have it completely deleted from the data stock of the controller.

In the case of consent, the legal basis for processing is Art. 6 (1) a) GDPR. If your registration serves to prepare the conclusion of a contract, Art. 6 (1) b) GDPR is the additional legal basis.

  1. Data transmission

We will only share your personal data with third parties if:

  1. a) you have given your express consent to this in accordance with Art. 6 (1) a) GDPR.
  2. b) this is legally permissible and necessary according to Art. 6 (1) b) GDPR for the fulfilment of a contractual relationship with you or the implementation of pre-contractual measures.
  3. c) there is a legal obligation for the transfer according to Art. 6 (1) c) GDPR. We are legally obliged to transfer data to state authorities, e.g. tax authorities, social insurance carriers, health insurance companies, supervisory authorities and law enforcement agencies.
  4. d) the disclosure is necessary in accordance with Art. 6 (1)fa) GDPR for the protection of legitimate business interests, as well as for the assertion, exercise or defence of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data.
  5. e) we make use of external service providers, so-called order processors, in accordance with Art. 28 GDPR, who are obliged to handle your data with care.

We use such service providers in the areas of: IT, logistics, telecommunications, marketing.

  1. Comment function

You can comment on articles on our website. When you comment on a post, we collect and store the data you enter in the input mask. In addition to the comments you leave, information on the time of comment entry and possibly the user name (pseudonym) you have chosen will also be stored and published. Furthermore, the IP address assigned by the Internet service provider (ISP) of the person concerned is stored. This information is not passed on to third parties.

The data transmitted by you (e.g. the IP address) is used for security reasons and in the event that the data subject violates the rights of third parties or posts illegal content through a submitted comment. No disclosure of this collected personal data to third parties takes place, unless such disclosure is required by law or serves the legal defence of the controller.

The legal basis for the processing of personal data transmitted when using the comment function is, if and insofar as you have given your consent, Art. 6 (1) a) GDPR. You can revoke this consent at any time. The legality of the data processing operations already carried out remains unaffected by the revocation. Another legal basis is Art. 6 (1) f) GDPR. We have a legitimate interest in processing if third party rights are violated or illegal content is posted. This serves security purposes in case someone writes unlawful content in comments and posts (insults, prohibited political propaganda, etc.).

  1. Contact form

On our website, we offer you the opportunity to contact us via a form provided. During the process of sending your enquiry via the contact form, reference is made to this data protection declaration in order to obtain your consent.

If you make use of the contact form, the following personal data of yours will be processed: First name; Last name; E-mail address; Subject; Your message.

The purpose of providing your e-mail address is to send you a reply to your enquiry by e-mail. When using the contact form, your personal data will not be passed on to third parties. The legal basis for processing is consent in accordance with Art. 6 (1) a) GDPR.

On our website you can contact us by e-mail and by using the contact form.

Our data collection is limited to the e-mail address of the e-mail account used by you to contact us as well as the personal data provided by you as part of the contact process.

The purpose of the data processing is to be able to answer your request appropriately. The legal basis for this is Art. 6 (1) f) GDPR. There is a legitimate interest in processing the above-mentioned personal data in order to be able to deal with your request appropriately.

  1. Newsletter

On our website you have the possibility to subscribe to a free regular e-mail newsletter. Our newsletter informs you regularly about topics and news about our company, offers and products. To be able to send you the newsletter regularly, we need your e-mail address. 

The data we collect when you register for the newsletter will be used exclusively for the purpose of advertising in the newsletter.

The processing of your e-mail address for the newsletter dispatch is based on your declaration of consent in accordance with Art. 6 (1) a) GDPR and § 7 para. 2 no. 3 UWG.

You can cancel the receipt of our newsletter at any time, i.e. revoke your consents. You will find a link to cancel the newsletter at the end of each newsletter and under the unsubscribe page.

Shopify Audiences

We use Shopify Audiences to serve ads on other websites with our advertising partners to shoppers who have shopped at other Shopify merchants and who may also be interested in our offers. We also share information about your use of the Site, your purchases, and the email address associated with your purchases with Shopify Audiences, through which other Shopify merchants can make offers that may interest you.

Google Analytics

We may use Google Analytics on our website. This is a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin, Ireland (hereinafter: Google).

The Google Analytics service is used to analyse how our website is used. The legal basis is Art. 6 (1) f) GDPR. Our legitimate interest lies in the analysis, optimization, and economic operation of our site.

Usage and user-related information, such as IP address, place, time, or frequency of your visits to our website will be transmitted to a Google server in the United States and stored there. However, we use Google Analytics with the so-called anonymization function, whereby Google truncates the IP address within the EU or the EEA before it is transmitted to the US.

The data collected in this way is in turn used by Google to provide us with an evaluation of visits to our website and what visitors do once there. This data can also be used to provide other services related to the use of our website and of the internet in general.

This add-on can be installed on the most popular browsers and offers you further control over the data that Google collects when you visit our website. The add-on informs Google Analytics' JavaScript (ga.js) that no information about the website visit should be transmitted to Google Analytics. However, this does not prevent information from being transmitted to us or to other web analytics services we may use as detailed herein.

Google Maps

Our website may use Google Maps to display our location and to provide directions. This is a service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin, Ireland (hereinafter: Google).

If you access the Google Maps components integrated into our website, Google will store a cookie on your device via your browser. Your user settings and data are processed to display our location and create a route description. We cannot prevent Google from using servers in the USA.

The legal basis is Art. 6(1) f) GDPR. Our legitimate interest lies in optimizing the functionality of our website.

Shariff Social Plug-ins

We may have included buttons from various social media platforms (Facebook, YouTube, Instagram) on our website. When you click on one of the buttons you will be forwarded to our company page on the respective platform. To protect your privacy, we have integrated the so-called Shariff solution: Only if you click on the button of one of the social media provider (e.g. Facebook) on our website your browser establishes a direct connection to the servers of the respective provider, which may be located in the USA. If you are logged into your user account with the respective provider, your profile data may be supplemented by information gained about your use of our content. YouTube videos

We integrate YouTube videos into our online offer, which are stored at http://www.youtube.com and can be played directly from our website. YouTube is a service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google").

YouTube collects your IP address, the date and time as well as information about the website you visited and the video you viewed. This takes place regardless of whether YouTube provides a user account via which you are logged in or whether no user account exists. In addition, a connection to the Google advertising network is established.

As long as you only call up one of our websites with an embedded YouTube video without playing the video, no data is transmitted to YouTube due to YouTube's "Extended data protection mode" function. Transmission only takes place when you actually start a video.

In order to save your desired setting regarding the playback of videos and the transmission of data to YouTube, we set a cookie. These cookies do not contain any personal data, they only contain anonymised data for browser customisation.

If you are logged in to YouTube at the same time, YouTube can associate the connection information with your YouTube account and use it for the purpose of personalised advertising. If you do not want your profile to be associated with your connection information, you must log out before activating the YouTube video.

You can revoke any given consent with respect to any future processing at any time, by deleting the comment or content. Please note, that any revocation of consent does not affect the legitimacy of the data processing prior to the revocation of consent.

Further, we assume joint control with Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin, for the processing of so-called Insights-data in connection with your visit on our Facebook sites. Facebook analyses user behaviour on our Facebook sites with the help of such Insights-data and provides us with these data in anonymized form. For this purpose we have concluded a joint controllership agreement with Facebook Ireland Ltd. that you may view at: www.facebook.com. This agreement includes without limitation that Facebook Ireland Ltd. commits itself to assume the primary responsibility according to the GDPR and to fulfil all duties under the GDPR with respect to the processing of Insights data. The processing serves our legitimate interests in the optimization and adequate composition of our Facebook sites, Art. 6 (1) f) GDPR.

Please note, that by using and loading our Facebook sites your personal data are also processed by the companies operating “Facebook”, i.e. Facebook Ireland Ltd. (4 Grand Canal Square, Grand Canal Harbour, Dublin, Ireland) and Facebook Inc. (1601 Willow Road, Menlo Park, California 94025, USA).

Apart from data processing operations described above, Facebook also processes your personal data for analysis and advertising purposes respectively to supply you with personalized advertisements.

In that process, as far as we know, Facebook uses cookies that record your user behaviour (and over the different devices you may use). As a consequence Facebook can display targeted advertisements within the Facebook platform as well as on third party websites. Storage period

The user may ask the seller to delete all the information related to him/her. In that case the user sends the user account removal request directly to the seller via corresponding email address found at the seller website.

The data is deleted as soon as it is no longer required for the purpose of its processing. In addition, there may be statutory retention obligations, for example, retention obligations under
commercial or tax law in accordance with the applicable laws. If such retention obligations exist, we will block or delete your data at the end of these retention obligations.
